Fürgefutár.hu is also responsible for providing full information on the parcel delivery to the Customer. Tasks include keeping in connection with the Customer and the Partners, and conveying and mediating between the Customer and the Partners during the parcel delivery service, from the collection of the parcel to the delivery to the address given by the Customer.
Fürgefutár.hu accepts orders and calculates prices only for small parcels, up to the weight of 250 kg (154 lbs). Telephone ordering is not available.
1.2. The Customer
The Customer is a private person, legal entity, business entity without a legal personality or another organization that accepts the Terms and Conditions and uses the services based on them. When using the services of Fürgefutár.hu, the private person, legal entity, business entity without a legal personality or the other organization indicated as the consignor or sender of the parcel is referred to as the Customer.
The client indicated as an addressee on the parcel or the package is referred to as the Addressee.
1.3. General Information
The General Terms and Conditions define in detail the object of the contract, the conclusion of the contract, the responsibility of the company and of the Customer, the definition of the consignment, the volume and weight limits on the parcels and requirements on parcel content formulated by the Partners. Fürgefutár.hu provides the consignment documents required for the parcels (Consignment Note of the Partner, Pro forma invoice, Export/import Customs Clearance Assignment, Import Admission Assignment, Certification for non-dangerous goods, Dual-use Items Declaration, CITES Document etc).
Fürgefutár.hu is responsible for organizing package delivery, for obtaining the necessary information and for collecting the package from domestic points, but is not responsible for the delivery itself.
Consignment: according to the present delivery conditions, a parcel within the volume and weight limits given, with all the data necessary for delivery indicated on the package (address, postal code, city, telephone number, name of addressee), together with the documents (Consignment Note).
Types of consignments: letters, parcels, packages and pallets that are delivered with a Consignment Note by Fürgefutar.hu via its Partners on public roads, on ships or by air.
The Customer is obliged to inform Fürgefutár.hu about the size, contents, collecting address and delivery address of the parcel(s). Fürgefutár.hu is not liable if the contents are falsely given on the ordering form. If the contents of the parcel differ from the contents given on the form, Fürgefutár.hu will devolve legal responsibility to the Customer. Fürgefutár.hu is responsible for transmitting the ordering forms collected from the Customer to its Partners.
1.4. Object of the Contract
According to the service contract, Fürgefutár.hu is responsible for handling and systematizing orders placed online or via telephone on parcels that meet the size, weight, contents and packaging requirements set up by the Terms and Conditions and in the regulations of the Partners, for transmitting these orders to its Partners, and for passing the consignment documents to the Customer via electronic mail.
Further object of the contract is that the conveyer signs the transportation and other contracts necessary for the delivery of the consignment, and manages any other duties related to the delivery. The conveyer signs the transportation and other contracts with third parties on its own behalf but for the benefit and at the costs of its consigner. Apart from the transportation contract, other contracts related to the delivery of the consignment may include further transportation contracts or transportation insurance contracts.
The transportation contract is concluded if the offer given by the conveyer is accepted by the consigner. The declaration of acceptance should be explicit.
In choosing the transporter, defining the transporting route and in all other duties, the conveyer should proceed regarding the principles of economy and consignment safety. In certain cases economy and safety can interfere in a way that one can be regarded only at the expense of the other. It follows that the conveyer should take all the steps necessary to choose the option that serves the best interests of the consigner.
The conveyer is obliged to follow the orders of the consigner. If the conveyer receives an order that endangers the economical or safe delivery of the consignment, the conveyer should immediately inform the consigner about this. If the consigner repeats the order in a written form, the conveyer is obliged to accomplish the order at the risk and costs of the consigner. Just like the conveyer, the transporter should also inform the consigner about any orders endangering the economical and safe delivery of the consignment.
1.5. Conclusion of the Contract:
The service contract is concluded by placing (confirming) the order and by filling in the consignment document sent by Fürgefutár.hu.
The conveying contract has no obligatory format, but conveyers may require formats that suit their characteristics best. The order will contain the following important information:
– Customer data (name, address, telephone numbers, e-mail address)
– Addressee data (name, address, telephone numbers, e-mail address)
– Billing data (name, address, telephone numbers, tax number in case of companies)
– Parcel size, weight, volume weight, weight charged
– Name and telephone number of the contact person
– Price of delivery (transporting, insurance, other costs)
– Conveyer Partner
– Method of payment
The consignment is collected by signing a proof of receipt. The Customer is obliged to print the consignment documents sent by Fürgefutár.hu via e-mail, and have them signed by the courier of the Partner company chosen. The starting date of the service contract is defined by the date indicated by the service provider, the exact date of the collection of the consignment and the collector’s signature. If the Terms and Conditions require a written format for the contract, then the contract is concluded when the written contract is signed by all parties. Fürgefutár.hu is obliged to provide all the documents and forms (including individual order confirmations) required for using the service for the Customer for free. Unless otherwise arranged in the contract, Partners are obliged to collect the consignment only if it is covered in a packaging suitable for its characteristics and size, and if the contents cannot be accessed without obviously damaging the package or the sealing. Requirements and advice regarding the way of packaging can be found in Section 12 of the Terms and Conditions.
The deadline for the settlement of the invoice – unless otherwise determined by the Terms and Conditions or the contract parties – is the first workday after the delivery of the consignment, eight workdays within receiving the invoice form the service provider. The payment deadline cannot be extended. The parties can deviate from the Terms and Conditions if agreed mutually, except if it is in contrast with the applicable law. The parties can not deviate form the Terms and Conditions if the deviation causes the collection, processing, or delivery of the consignment to endanger life, health, psychical integrity, or the addressee’s right for the safe receipt of the consignment.
Contracted Partners of Fürgefutár.hu Ltd. are GLS, TNT, UPS, G4S, QX, DPD and TCE courier delivery services. The premise of the use of the services is that the Customer is obliged to print the consignment documents sent by Fürgefutár.hu, place them next to the consignment, and hand it over to the courier of the Partner. Partners collect all consignments that meet the requirements set in their respective Terms and Conditions.
